Terms of Service

1. Acceptance of Terms

By accessing or using FwdJob ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Your continued use of the Service constitutes acceptance of any updates or modifications to these terms.

2. Description of Service

FwdJob is a referral network that connects job providers (recruiters, agencies, and companies) with job seekers through chains of trusted personal connections. Job postings enter the system via email, are validated, and are automatically distributed through the network based on user connections and keyword matching. FwdJob is not a recruiter, staffing agency, or employer.

3. User Accounts & Eligibility

You must register with a valid personal email address. Each person may hold only one account. You agree to provide accurate, current, and complete information during registration and to keep your profile up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. User Roles

Seekers are individuals who may receive job postings matched to their keywords. Seekers can be in a "looking" or "not looking" state. When not looking, jobs flow through them to their connections.

Providers are recruiters, agencies, or companies that submit job postings into the network. Providers set a referral fee for each posting or a default fee for all postings.

5. Referral Fees & Payments

Providers set a referral fee when submitting job postings. When a candidate accepts an offer for a job that was distributed through the network, the referral fee is split among all users in the referral chain that routed the job to the candidate. Each node in the chain retains half of the remaining fee, with the rest distributed onward.

Payments are processed through Stripe. FwdJob is not responsible for delays, failures, or disputes in payment processing. FwdJob does not guarantee that any referral fee will be collected or paid. Fee collection depends on the provider fulfilling their payment obligation.

6. Email Forwarding

Each user is assigned a unique @fwdjob.com email address. Job postings sent to this address are processed, validated, and distributed through the network. By using the Service, you consent to receiving job-related emails at the personal email address you registered with. You may also forward job postings you receive elsewhere to your @fwdjob.com address to enter them into the system.

7. User Conduct

You agree not to:

• Create multiple accounts or impersonate another person
• Submit spam, fraudulent job postings, or misleading content
• Create fake profiles to intercept job postings or referral fees
• Attempt to game the referral fee system or manipulate the network graph
• Use the Service for any purpose other than legitimate job seeking or providing
• Interfere with or disrupt the Service or its infrastructure

8. Intellectual Property

The FwdJob name, logo, and all related software, design, and content are the property of FwdJob. You retain ownership of any content you submit (such as profile information and job postings), but grant FwdJob a license to use, process, and distribute that content as necessary to operate the Service.

9. Disclaimers

FwdJob is not an employer, recruiter, or staffing agency. We do not vet, endorse, or guarantee any job posting, provider, or candidate. The Service is provided "as is" without warranties of any kind, express or implied. FwdJob does not guarantee that you will receive job postings, find employment, fill a position, or receive referral payments.

10. Limitation of Liability

To the maximum extent permitted by law, FwdJob and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount of referral fees you have received through the Service in the twelve months preceding the claim.

11. Termination

We may suspend or terminate your account at any time for violation of these terms or for any other reason at our discretion. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately. Any pending referral fees that have not yet been collected may be forfeited.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised terms.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved in the courts of Ontario, Canada.
